This Accident Waiver, Release of Liability, Indemnity, and Media Release (the "Waiver") is entered into on {sign_date}, between Six Blades Denver Jiu-Jitsu (DBA), located at 7444 S University Blvd, Littleton, CO 80122 (the "School"), and (the "Participant" or, if signing on behalf of a minor, the "Responsible Party"). By signing below, the undersigned acknowledges and agrees to all terms set forth in this Waiver.
 
1. ACKNOWLEDGMENT OF RISKS
 
The undersigned hereby recognizes, appreciates, and acknowledges that:
 
Martial arts training, including Brazilian Jiu-Jitsu, involves activities that are physically, mentally, and emotionally demanding and may involve physical contact including choke holds, arm locks, neck cranks, ankle locks, throws, slams, and takedowns.
 
Participation in such activities may result in serious bodily injury, including permanent disability, paralysis, or death.
 
Such injuries may arise not only from the Participant's own actions, but also from the actions, inactions, or negligence of others — including ordinary negligence on the part of the School or its staff — the rules governing participation, the conditions of the premises, or the equipment used.
 
In addition to bodily injury or death, participation in the activities offered by Six Blades Denver Jiu-Jitsu (DBA) carries the risk of economic and social damages arising from such injuries.
 
There may be other risks not currently known or reasonably foreseeable at this time.
 
2. ASSUMPTION OF RISK
 
The undersigned voluntarily and knowingly assumes all risks of participating in any and all classes, events, and activities offered by Six Blades Denver Jiu-Jitsu (DBA), whether on or off the School's premises. This assumption of risk includes, but is not limited to, risks arising from the ordinary negligence or carelessness on the part of the School, its officers, directors, employees, agents, or other participants. The undersigned expressly acknowledges that this assumption of risk extends to injury caused by the School's own ordinary negligence.
 
3. PHYSICAL CONDITION
 
The undersigned affirms that the Participant is in good physical condition and does not suffer from any known disability or condition which would prevent or limit participation in this exercise program. The undersigned understands that participation in the School's program and use of its equipment and facilities shall be undertaken at the Participant's sole risk.
 
4. RELEASE OF LIABILITY
 
To the fullest extent permitted by Colorado law, the undersigned, for themselves and for their successors, heirs, and assigns, hereby waives, releases, and forever discharges Six Blades Denver Jiu-Jitsu (DBA) and its officers, directors, employees, members, shareholders, partners, affiliates, agents, successors, and assigns (collectively, "School Affiliates") from any and all liabilities, claims, causes of action, suits, debts, obligations, promises, damages, costs, and expenses whatsoever, whether based on tort, contract, statutory, or other theory of recovery, known or unknown, which the undersigned, or their heirs, successors, or assigns, ever had, now have, or may have in the future, related to participation in any classes, events, and activities offered by Six Blades Denver Jiu-Jitsu (DBA). This release includes claims arising from the ordinary negligence of the School or any School Affiliate.
 
5. INDEMNIFICATION
 
The undersigned agrees not to initiate, assign, maintain, prosecute, or otherwise participate in any action or claim against Six Blades Denver Jiu-Jitsu (DBA) or any School Affiliate that is derived from, related to, or otherwise connected to the claims released above. The undersigned shall indemnify and hold harmless Six Blades Denver Jiu-Jitsu (DBA) and all School Affiliates from any and all liabilities or claims arising as a result of participation in any classes, events, and activities offered by the School, including claims arising from the School's ordinary negligence.
 
6. EMERGENCY MEDICAL TREATMENT
 
The undersigned acknowledges that in the case of injury, accident, or emergency arising from participation in classes, events, or activities offered by Six Blades Denver Jiu-Jitsu (DBA), medical treatment — including emergency medical treatment — may be required. In the event the Participant lacks the capacity to make an informed decision regarding such treatment, the undersigned hereby consents to receive medical treatment deemed advisable by School personnel or emergency responders, and waives any claims or demands arising from such treatment. The undersigned agrees to bear all associated medical expenses.
 
7. DISMISSAL POLICY
 
Six Blades Denver Jiu-Jitsu (DBA) reserves the right to dismiss any participant at any time for misconduct or actions that are inconsistent with the School's philosophy, practices, or that may negatively reflect on the School. No refund will be issued upon dismissal.
 
8. LAW ENFORCEMENT POLICY
 
Applicable for all law enforcement agents: The undersigned affirms that all techniques taught by Six Blades Denver Jiu-Jitsu (DBA) do not supersede department policy and are intended solely for personal development and lawful application.
 
9. MEDIA RELEASE
 
The undersigned grants Six Blades Denver Jiu-Jitsu (DBA), its agents, and assigns unrestricted permission to photograph, video record, or audio record the Participant while participating in any classes, events, and activities provided by the School. The undersigned further grants Six Blades Denver Jiu-Jitsu (DBA) unrestricted permission for such images, videos, and recordings to be used in print, video, digital, and internet media for marketing, communications, or advertising purposes, without further notification or compensation. The undersigned waives any right to inspect or approve the use of such materials.
 
The undersigned gives to Six Blades Denver Jiu-Jitsu (DBA) all right, title, and interest in all finished pictures, negatives, reproductions, and copies of the original print, and grants the School the right to give, sell, transfer, and exhibit such materials for marketing, communications, or advertising purposes.
 
The undersigned releases Six Blades Denver Jiu-Jitsu (DBA) and its agents and assigns from any claims that may arise from these uses, including without limitation claims of defamation, invasion of privacy, or infringement of rights of publicity or copyright.
 
The undersigned acknowledges that all areas of the facility, excluding bathrooms and changing rooms, may be subject to audio or video monitoring, which may be used by the School and may be made available online.
 
10. ENTIRE AGREEMENT & SEVERABILITY
 
This Waiver constitutes the entire agreement between the undersigned and the School with respect to the subject matter herein, superseding all prior agreements. If any provision is found to be unenforceable, the remaining provisions shall remain in full force and effect. This Waiver shall be governed by the laws of the State of Colorado.

I acknowledge that this is a legally binding document and that I am waiving significant legal rights, including the right to sue for ordinary negligence. If signing on behalf of a minor, I affirm that I am the parent or legal guardian of {name} and have full legal authority to execute this Waiver.

Legal Equivalence: My electronic signature is legally binding and carries the same force and effect as a handwritten signature, in accordance with the Colorado Uniform Electronic Transactions Act, C.R.S. § 24-71.3-101 et seq., the federal Electronic Signatures in Global and National Commerce Act (ESIGN), 15 U.S.C. § 7001 et seq., and all other applicable law.
 
Identity & Capacity: I affirm that I am at least 18 years of age and of sound mind, and that I have full legal capacity to execute this Waiver. If signing on behalf of a minor, I affirm that I am the parent or legal guardian of {name} and have full legal authority to bind the minor to the terms of this Waiver.
 
Intent to Be Bound: My electronic action constitutes an intentional, voluntary, and affirmative act signifying my agreement to be legally bound by all terms and conditions in this Waiver, including the release of liability, assumption of risk, indemnification, and media release.
 
Receipt of Document: I acknowledge that I received, had the opportunity to read, and understand this entire Waiver prior to signing. I was not pressured, coerced, or misled into signing.
 
Consent to Electronic Records: I consent to receive, execute, and retain this Waiver and all related communications in electronic form. A copy of this signed Waiver will be available through the School's member portal at {login_link}.
 
Timestamp & Audit Trail: I understand that my electronic signature will be recorded with a date/time stamp, IP address, and other identifying metadata, which may be used as evidence of my consent in any dispute or legal proceeding.
 
No Repudiation: I agree that I will not deny the authenticity, validity, or enforceability of this Waiver on the grounds that it was signed electronically.
